Reference is made to City of Carrollton application for rezoning Case No. 04*03Z1 by myself which was denied by city council and reopened under rezoning case 12*05Z1 at the request of Mr Kenny Marchant.

I hereby request an unequivocal explanation of why the above case was denied under my name and approved under Mr. Marchant's name, project which is being built now using my own design?

As you know my case was considered and denied on June 3, 2003 at that time, city council members Becky Miller, Tim Hayden, Larry Williams and Herb Weidinger opposed to my case, all of these members with the exception of Mrs. Becky Miller who is now Mayor, are still active members of the council and all of them voted in favor of the application made by Marken Interests which is owned by Mr. Kenny Marchant.

According to the records, the Marchant family/Marken Interests first submitted their application for rezoning in Dec. 2004 but it was withdrawn by themselves, then resubmitted in Oct, 2006 when it was approved unanimously without even discussing it in public, the same council members that opposed my case approved the Marchant family case.

your design, which was copied from my design are almost identical and are governed by the same policies and ordinances of the city's comprehensive plan.

The only explanation I was given for the denial was that the site only had a single point of entry from the main street, however the design submitted by the Marchant family representative also has the same single point of entry.

At the time I submitted my application, the land was owned by the Simms Chapel African Methodist Episcopal Church, my contract for purchasing the land from the church was contingent on me obtaining approval for rezoning the property from office use to residential use. The land was sold to the church by Mr. Kenny Marchant ( former Mayor of the city of Carrollton and father of Mr. Mathew Marchant city council member) who financed the sale and held a lien on the property, once my case was denied and due to the fact that the church could no longer afford loan payments to Mr. Marchant because they had no use for the land, the property was foreclosed by Mr. Marchant taking immediate possession of the same to build the project I designed.

Mr. Marchant owned the property for several years prior to selling it to the church, during all of that time even though Mr. Marchant is a major developer and home builder, he was unable to come up with a feasible design on the property due to its irregular configuration, it was until he saw my design that he realized that the land could be profitable.

So, needles to say, Mr. Marchant kept the Church's down payment which I understand was a considerable amount, got a free design for the development of the land from me, got the property rezoned with the help of city council members and now is building homes on the property for a considerable profit.
